“Milly Rock” Dance + Fortnite Lawsuit = Are Dance Moves Protectable IP?

Several performers and other artists have voiced concerns or given criticism about their signature dance moves being used in Fortnite Battle Royale as purchasable “emotes,” which range from actions, gestures, and dances that character can act out at different points in the game. Well 2 Milly, the rapper behind the “Milly Rock” dance, is taking Epic Games to court over their “swipe it,” which is an exact copy of the ‘Milly Rock’ dance, on the grounds that the artist who originally created the dance should be compensated since Epic Games makes money by selling emotes to players in Fortnite.
